“What are you saying? Prime contains Forever Chemicals?” Yes, I am saying exactly that. So, what is the case really about? What should you know about this class action lawsuit? And are the plaintiffs going to get a settlement?

Additionally, another case claimed that the particular Grape flavor of the energy drink was falsely marketed as a healthy drink. But in reality, it contained extremely high amounts of PFAS.

In 2024 (during the Olympics) the company again faced a lawsuit. But this time it was pretty big. The US Olympic committee sued Logan’s Prime Drink in a trademark case.

The lawsuits seek damages and injunctive relief to address these concerns, with ongoing legal proceedings as of January 2025.

But in today’s blog, I will be primarily focusing on the ongoing Forever Chemicals Prime Lawsuit.

Background to the Forever Chemicals Prime Lawsuit 

At present, the popular Prime Drinks is facing a class action lawsuit over the allegations that it contains PFAS chemicals in its Hydration product line. It also contains a high amount of caffeine in all their energy drinks.

Now, it is true that all energy drinks contain caffeine. The caffeine in these drinks acts as a stimulant and energy booster. And this is exactly why you feel more active and productive once you have these drinks in your system.

However, there is a permissible limit to the amount. Regarding Prime Energy Drinks, caffeine is around 200 mg in a 355 ml can. This is almost six times the amount of caffeine present in a can of Coke.

But wait a minute. The case does not end there.

The popular energy drink faces a major allegation about “forever Chemicals.” Plaintiffs claim that the company misled consumers regarding the safety of its products, which allegedly contain toxic levels of PFAS that exceed EPA limits for drinking water.

Moreover, the lead plaintiff, Elizabeth Castillo’s lawsuit highlights health risks associated with PFAS, prompting ongoing legal scrutiny.

What are Forever Chemicals?

For those who are not aware of what the hell this “Forever Chemical” is, fear not. Let me explain. This substance (which, to me, sounds like some sort of Lana Del Ray song) is one of the toxic things that your favorite drink contains.

“Forever chemicals,” scientifically known as PFAS (per-and poly-fluoroalkyl substances), are a group of over 10,000 synthetic compounds used for their water and grease-resistant properties in various products, including non-stick cookware, food packaging, and textiles.

They are notorious for their persistence in the environment and human body, leading to bioaccumulation.

Most people often ask why (and which) companies use these chemicals. Let me tell you. Forever chemicals are commonly found in a variety of products, including:

• Food Packaging: Pizza boxes, microwave popcorn bags, and takeout containers.
• Household Items: Non-stick cookware (like Teflon), carpets, and furniture textiles.
• Clothing: Waterproof and stain-resistant garments, including raincoats and outdoor gear.
• Personal Care Products: Shampoo, dental floss, nail polish, and makeup.
• Medical Equipment: Masks and other protective gear.
• Cleaning Products: Some household cleaners may also contain PFAS.

These chemicals are used for their water and grease-resistant properties. However, studies have shown that they pose significant health risks due to their persistence in the environment and human body

Health risks associated with PFAS exposure include increased chances of cancer (particularly kidney and testicular), liver damage, high cholesterol, and immune system suppression.

What was Logan’s Response to the Allegations?

In response to the ongoing lawsuits, Prime Hydration has not publicly disclosed specific actions taken to address the allegations regarding PFAS chemicals and excessive caffeine levels.

However, the company continues to market its products while facing legal challenges, including this very class action lawsuit that I am talking about over the presence of PFAS in its drinks.

On his social media handles, Logan addressed the lawsuit:

“First off anyone can sue anyone at any time that does not make the lawsuit true. And in this case, it is not. CFOs or forever chemicals come from plastic. So in this case, they’re not talking about the actual drink, the liquid itself— Prime— they’re talking about the bottle that Prime is manufactured in. This ain’t a little rinky dink operation, we use the top bottle manufacturers in the United States. All of your favorite beverage brands, Coke, Pepsi, Tropicana, Dr. Pepper, they use these companies. If the product is served in plastic, they make a bottle for them.”

Legal and Financial Implications of the Prime Forever Chemicals Lawsuit

Following the lawsuit against Prime in April, the US Senate and House of Representatives introduced the Forever Chemical Regulation and Accountability Act (FCRAA).

The FCRAA aims to eradicate all “nonessential” usage of PFAS, as explained in more detail in our most recent consumer products notice.

If approved, PFAS producers and consumers would have to ask the EPA to declare their PFAS applications necessary.

Manufacturers and users whose petitions are approved are required by the Act to report to the EPA on particular PFAS use details.

In order to prove that they will stop using PFAS for non-essential purposes within 10 years, businesses might also have to submit a phase-out timeline. Similar state legislation is being developed and is gaining traction.

Prime Lawsuit Forever Chemicals: Should You Expect a Settlement?

As of now, there are no reported settlements or agreements being discussed between Prime Hydration and the plaintiffs in the ongoing class action lawsuit regarding PFAS.

The lawsuits remain unresolved, with plaintiffs continuing to seek damages for alleged harmful ingredients and misleading marketing practices.

Prime Hydration has not publicly indicated any negotiations toward a settlement, and the case is still in litigation as of January 2025.

According to Khan-Lavin, creator of the UK-based drinks marketing firm YesMore, Prime has become popular among younger people due to a societal preoccupation with popularity, fame, and influencers.

Let’s face it: the majority of Prime customers are children. Popularity is becoming a currency, and fame is a prerequisite for it.

Therefore, at a critical juncture in their development, children will naturally identify with brands that help give them an identity, whether that be the energy drinks they drink, the trainers they wear, or the vehicle their parents drive them to school, he says.

He believes that this large group of young, impressionable buyers will probably ignore the health hazards (as their parents and grandparents did with alcohol or cigarettes) and prefer the popularity of others seeing them with such a product, which is a little concerning.

However, the following outcomes could occur if the well-known YouTuber loses the lawsuit:
