While In The US, How Can You Request And Certify A Criminal Record Certificate From The Czech Republic?

If you once resided in the Czech Republic and must now demonstrate that you had no legal issues during your time there, you may need a Czech criminal record certificate.

You may find yourself in need of a criminal background check when applying for a residency permit in a third country, as well as when seeking employment outside of the United States.

In the following section, we will walk you through the various methods for acquiring the criminal record certificate and the recommended procedures for certifying it.

Who Is Responsible For Issuing Czech Police Clearance Certificates?

As a rule, criminal record certificates from the Czech Republic are issued on the territory of the Czech Republic.

While there are ways to get the document outside the country (we will review this option later), the best course of action is to handle the process locally, within the Czech Republic.

Furthermore, if you want to obtain the Czech criminal record certificate, you will have to submit the following documents.

  • Passport or the Original Proof of Your Identity.
  • Complete Form, in the PDF Format, and a File Size of 220 KB.

Moreover, you will need to pay the administration fee. The processing time can be up to eight weeks.

In addition, if you want to use these certificates in a different country, you will need an extra layer of authentication from the Ministry of Foreign Affairs of the Czech Republic.

Also, if you need an apostille, you can apply for the same through the Embassy and pay additional fees for the same.

Additionally, in the Czech Republic, the following bodies are responsible for issuing these documents.

1. A Dedicated Office Within The Ministry Of Justice

It is established specifically to provide criminal record certificates. That said, this unit is unique, and there is only one in the country, located in Prague.

2. Every Notary In The Czech Republic

Notaries have direct access to the criminal registry and can therefore issue the certificates.

3. Czech Point Service Points

These service points include post offices as well as city and district administration offices.

Be aware that certificates from post offices and administration offices have no recognition beyond the border.

This is because you cannot authenticate them with an apostille.

What this means is that each of these cases demands an actual person in the country, or someone to submit the application for the certificate to the proper Czech government agency.

You also need a person to pick up the document itself once it is ready and arrange for the certification.

The good news is that there are services for obtaining a criminal record certificate from Czech Republic, which can help you secure a criminal record certificate, including fully remotely.

Obtaining A Criminal Record Certificate Once You Leave The Czech Territory

Once you leave Czech territory, Czech consulates are the only authorities to issue Czech police clearance certificates.

Despite being a relatively small country, the Czech Republic operates a considerable number of embassies and consulates worldwide, including several across the USA.

While these consulates often issue Czech criminal record certificates directly, there are two factors to note:

1. Some Czech Consulates And Embassies Do Not Provide This Service At All

The reasons behind this are unclear – as far as we can tell, it depends on each individual Czech diplomatic mission. As a result, you will have to inquire on a case-by-case basis.

2. You Cannot Obtain An Apostille For Criminal Record Certificates From Czech Embassies Or Consulates

And in most cases, an apostille is necessary, as the certificate is most often presented outside the Czech Republic.

To have such a certificate accepted in the United States, an apostille is an absolute must.

Please bear in mind that under Czech law, certificates issued by a Czech diplomatic mission are considered domestic documents intended solely for internal Czech purposes.

By law, it cannot be recognized beyond the nation’s borders. In reality, a consular certificate is still accepted fairly often in practice.

For example, if you need it for a job application and the employer is a private company, they might find it perfectly sufficient.

What Is The Most Effective Way To Authenticate The Certificate?

From what we have seen, whenever someone asks for a Czech police clearance certificate, it is almost always because they plan to use it outside of the Czech Republic.

This may happen when a person needs it to obtain a residence permit in another country or for employment purposes.

To explain further, when a person once lived in the Czech Republic and now, while applying for residency elsewhere or looking for work in a different country, needs to confirm that they had no legal issues in the Czech Republic.

Consequently, the document must be certified in a way that ensures it will be recognized beyond the Czech borders.

Moreover, for a Czech criminal record to be valid overseas, you can explore the following certification options.

1. Certification From The Czech Ministry Of Justice’s Specialized Office

Keep in mind that the country’s criminal records register is managed by the Ministry of Justice.

Therefore, their stamp and certification carry significant weight.

However, the downside is that the only office in the whole country provides this service (the one located in Prague).

2. Certification By Any Notary In The Czech Republic

This is another solid choice. The certified documents work beyond the nation’s borders.

According to both methods of certification, you can apply for an apostille afterwards.

Do You Need An Apostille For A Czech Criminal Background Check?

Often, you will need an extra layer of certification or an apostille for the acceptance of a Czech criminal report abroad.

An apostille is a special seal that confirms the document is valid beyond Czech borders.

But how do you determine if an apostille is necessary for your case?

This depends on the country in which you plan to use the document.

For the recognition of a certificate in the United States, an apostille is definitely necessary.

However, for other countries, you will have to verify the requirements on a case-by-case basis.

Also, you will generally encounter one of two situations.

Either an apostille is mandatory, or the certificate will be accepted without one.

However, even in situations where an apostille is not technically necessary, the authorities or organizations reviewing your document may still demand it for use in the destination country.

For this reason, we strongly advise obtaining an apostille anyway just to be on the safe side.
