Spain decided many years ago — in the 1990s — that having a small amount of cannabis for personal use would not be a crime. This means you won’t go to jail just for having a little bit.

But if you have a lot, sell it, or smoke in public, that’s a different story. You could still get fined or face charges.

Spain wanted to make things fair by allowing people to use a little bit privately without being treated like big criminals.

How Much Cannabis is Legal in Spain?

If you are at home, you can carry up to 100 grams of cannabis for your consumption. That is approximately the weight of a small apple!

When the police find that you have more than 100 grams, they will suspect that you are selling it, which is considered illegal.

Even if you are only in possession of a small amount, you will get a fine for smoking in public – that is a way of paying money as a punishment.

It is important to always be careful about the quantity you are taking and the places where you are using it.

Can You Manufacture or Import Cannabis in Spain?

No, it is not allowed to produce or bring in cannabis legally in Spain, unless for scientific or medical purposes where the government has to give you special permission.

Typically, growing a couple of plants at home is not prohibited, but only if they are out of sight from the road.

However, things like making lots of drugs, selling them, or bringing them from another country, without permission, are illegal, and for such actions you might face imprisonment.

What Drugs are Legal in Spain?

Now, let’s talk about other drugs. Spain has different rules for different types of drugs. Some are treated lightly, and others are very serious. Let’s break it down simply:

1. Cannabis

As I have said, cannabis is decriminalized for personal use in private spaces. But selling it or using it in public is illegal.

2. Tobacco

Tobacco is legal in Spain for adults over 18 years old. You can buy cigarettes and smoke them, but not inside public places like restaurants or malls.

3. Alcohol

Alcohol is also legal if you are over 18. You can drink beer, wine, and other drinks in most places like bars and restaurants. But drinking in the streets (public drinking) can sometimes be illegal in certain cities.

4. Hard Drugs (like Cocaine or Heroin)

Hard drugs are illegal. Even having a small amount for yourself can get you in big trouble. The police do not allow the use of dangerous drugs that can harm your body a lot.

5. Prescription Drugs

Medicines that a doctor gives you, like painkillers or anxiety pills, are legal only if you have a prescription. If you carry strong medicines without a doctor’s note, you could face legal problems.

So, while Spain is a little relaxed about cannabis and alcohol, it is very serious about hard drugs and illegal selling!
